Powers of Attorney in Thailand
A power of attorney lets you authorise another person to act on your behalf — to sign documents, transfer property, or handle official matters when you cannot be present. Used correctly it is a powerful convenience; drafted carelessly it can be a serious risk.
General vs Specific Powers
A specific (or special) power of attorney authorises a defined task, such as a single land transfer or one company filing. A general power of attorney grants broad authority. For most purposes a specific power is safer, because it limits exactly what the attorney can do.
Common Uses
- Transferring or mortgaging property when you are abroad
- Registering or amending company records
- Dealing with government offices and banks
- Managing affairs during illness or extended travel
Formalities Matter
Many Thai authorities require their own prescribed power-of-attorney form, signed before witnesses, with copies of identity documents attached. A power of attorney executed abroad usually needs notarisation and legalisation before it can be used in Thailand. We make sure the document meets the exact requirements of the office that will receive it.
Protecting Yourself
Because an attorney can bind you legally, the wording must be precise and the person must be trustworthy. We draft tightly scoped powers of attorney and advise on safeguards so the authority cannot be misused.
